Baltimore Brazilian Jiu Jitsu Warning, Waiver, Release of Liability, Assumption of Risk and Agreement to Participate
THIS AGREEMENT MUST BE SIGNED BY ALL MEMBERS WHO WISH TO PARTICIPATE IN ANY BALTIMORE BRAZILIAN JIU JITSU SANCTIONED EVENT.
Release and Assumption of Risk
Participant Name:("Releasor"), in favor of Baltimore Brazilian Jiu Jitsu, and Robert Sullivan, 501 Eastern Blvd, Essex, MD 21221 ("Releasee").
Releasor, being of lawful age (18+), understands and acknowledges that Jiu Jitsu is a sport involving inherent risks of bodily harm. Participation includes physical contact, which, while not intended to cause serious injury under the conditions practiced at Baltimore Brazilian Jiu Jitsu, may result in bodily harm through the actions of participants. The sport includes throws, take-downs, locks, chokes, and other potentially hazardous techniques. Although instruction aims to teach self-defense, practicing these techniques exposes participants to injury, including but not limited to wrestling styles such as Folkstyle, Freestyle, and Greco-Roman.
Instruction and Safety Protocols
Portions of class involve instructors teaching and demonstrating techniques, requiring students to "spar" with each other and/or the instructor. Students must immediately signal—by tapping or verbally—to cease contact once a technique is sufficiently applied, and all participants are instructed to promptly stop physical contact upon such signals.
Understanding and Acceptance of Risks
Baltimore Brazilian Jiu Jitsu takes extensive measures to prevent injury, but Releasor fully understands that practicing Jiu Jitsu remains inherently dangerous. Baltimore Brazilian Jiu Jitsu is not responsible for the intentional, reckless, or negligent actions of other students. Close contact may result in the transmission of skin diseases, infections, viruses, or other ailments (including but not limited to abrasions, cuts, and sprains).
Release of Liability
In consideration of being permitted to participate in Jiu Jitsu at Baltimore Brazilian Jiu Jitsu, Releasor, for themselves and their heirs, executors, administrators, and assigns, releases and forever discharges Releasee, its employees, instructors, agents, sponsors, advertisers, owners, and assigns from any claim, demand, action, or right of action, for any incident, accident, or occurrence related to participation in Jiu Jitsu or activities on Releasee’s premises. Additionally, Releasee is released from any claim regarding first aid, treatment, or services rendered during or after participation.
Entire Agreement
This Release contains the entire agreement relating to the subject matter herein. All prior and contemporaneous agreements, written or oral, are merged herein and are of no further force or effect. Modification or amendment may only be made by written agreement signed by both Releasor and Releasee.
Severability
If any provision is declared illegal, unenforceable, or void by a court of competent jurisdiction, the remainder of this Release shall continue in full force and effect.
Governing Law and Venue
All questions regarding validity and interpretation shall be governed by the laws of Maryland. Venue for any actions shall be the State Courts located in Baltimore County, Maryland.
Arbitration Agreement
Releasor agrees that all disputes relating to this Release, whether in contract or tort, shall be submitted to binding arbitration in Maryland in accordance with the Maryland Uniform Arbitration Act (§§ 3-201 - 3-234). Arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules before a mutually agreed arbitrator, whose decision shall be final and binding. Judgement may be entered in any court with jurisdiction. The arbitration proceedings will be governed by Maryland law, and Releasor consents to personal jurisdiction of Maryland state courts for arbitration matters.
